Two things are bound to be highlighted, concerning those penologists' abortionists who base their justification, on saying: "One must have scientific honesty to be consequent with the own ideas". But scientific honesty in order to respect the human right to live, three "small" conditions have to be met: to leave data (phenomena) scientifically certain (proven), properly interpreted tenor of an understanding of the phenomenon in their specificity, and third, elementarily seated on a good argument. Here our critic is centered to reach a conclusion that at least is not as inconsistent as the proposal for this group of scientific penologists! The dignity of the human life is a value in itself, that which bears a deontology or duty anthropological foundation of all ethical and juridical duty.
