Assessment of evidence: sound judgment in the framework of virtual justice

Abstract

The Venezuelan system of valuation of evidence is defined as mixed, according to doctrine and legislation, the “sound judgment” is conceptualized as a legal instrument, as a system for the free appreciation of evidence and as a principle of universal acceptance and proven usefulness because the ultimate goal for the judge is the search for justice and truth, using to decide what is alleged and proven in the case, assuming that the rules are applied based on the context, social and historical reality of the moment to protect the order and social welfare. For no one is a secret that the law that has been exercised in Venezuela has been mostly with traditional means, being able to be and as it was in the pandemic moment virtually, coerced by a situation of mayor force, it must be understood that the law is not static, because the society is evolving and unpredictable, it is a basic pillar of coexistence and human order, which is present from the moment a person is classified by law as a person, until the moment that person dies. Although virtual justice is a fact that cannot be ignored, it is necessary to determine with precision the doubts of how, when and how? And in what manner? It can be applied in Venezuelan law, and how it affects the legal process, specifically the valuation of evidence through the use of the evidence by means like the sound judgment.
