El Nacional case: the instrumentalization of justice and the simulation of moral damage

Abstract

The ruling on the case of El Nacional shows the instrumentalization of the Supreme Court of Justice to fit, in the name of moral damage, a disproportionate sanction against that media and thus sends a strong message to the rest of the media: if this happens to one with so much history, so visible and powerful in the social imaginary of the country, it is not difficult to assume what can happen to small and medium-sized media. It is an open call for the deepening of self-censorship and another example of censorship.
