La Libertad de Expresión y el Proyecto de Reforma de la Ley de Ejercicio del Periodismo

Resumen

El autor considera en este artículo las razones de carácter constilucional que justifican la existencia de una ley que regule el ejercicio del periodismo y cómo el derecho a la libertad expresión, como otros derechos ciudadanos, tiene algunas limitaciones establecidas en la misma carta Magna. Se concluye
que el proyeclo de reforma de la Ley presentado por el Colegio nacional de Periodistas al Congreso, tampoco va en contra de los tratados internacionales suscritos por Venezuela en materia de libertad de expresión. Si así fuera el caso, señala el autor, habrá que pensar que dichos tratados son inconstitucionales, lo cual debiera solucionarse a través de la Ley Fundamental y del Derecho Internacional.

Abstract

The author considers in this article the reasons of constitutional character that justify the existence of a law that will regulate the practice of journalism and how the right to freedom of speech, like other citizen rights, has some limitations established by the constitution. It finally points that the project of reform of the law presentd by the National Association of Journalists to the Congress, doesn't go against the international treaties suscribed by Venezuela concerning freedom of speech. If this was the case, the author points, this treaties are then unconstituional, and the problem must be solved thorugh Fundamental and International Law.
